Terms of Service

Ganyu is a Discord bot and online service accessible via the website ganyu.fr (hereinafter "the Service"). These Terms of Service (ToS) apply to:

  • The Ganyu Discord bot (ID: 1447776996825235536).
  • The ganyu.fr website.

The Service is published and operated by the company VSK, a French SARL with variable capital whose full identification appears in the legal notice at the end of this page. In these ToS, "VSK" refers to this publisher.

1. Consent

By using Ganyu, you fully accept these ToS. If you do not accept these conditions, you must not use the Service.

2. Terms of use

  • One account per user: You must only use one Discord account to interact with Ganyu.
  • Prohibition of automated systems: You must not use bots, macros, scripts, or any other automated tool to gain an unfair advantage over other users (e.g., cheating in mini-games, manipulating the virtual economy, etc.).
  • Respect Discord rules: You must comply with Discord's Terms of Service and the rules of servers where Ganyu is used.
  • Legal use: You must not use Ganyu for illegal, fraudulent, or harmful activities.

3. Minimum age

The Service is reserved for people aged at least 15, the age from which a minor can consent alone to the processing of their data in France (article 45 of the French Data Protection Act, Loi Informatique et Libertés). A person under 15 may only use the Service with the agreement of the holder of parental authority. In every case, the user must also meet the minimum age set by Discord in their country. Premium purchases are reserved for adults, or for minors with the agreement of their legal guardian.

Premium subscriptions and shop purchases are governed by the terms of sale.

5. Disclaimer of warranty

Ganyu is provided "as is", without warranty of any kind, express or implied. VSK does not guarantee that the Service will be free of errors, interruptions, or defects. VSK cannot be held liable for direct or indirect damages resulting from the use (or inability to use) Ganyu. This clause does not limit the rights consumers hold under the law.

6. Privacy policy

Ganyu's Privacy Policy is incorporated by reference into these ToS. By using Ganyu, you also accept the conditions set forth in this policy.

VSK reserves the right to suspend or terminate your access to Ganyu, at any time and without notice, in case of violation of these ToS or Discord rules.

These ToS are governed by French law and European Union law, subject to the mandatory rules that protect consumers. Subject to the same rules, any dispute falls under the jurisdiction of the French courts. Paid offers, consumer mediation and the consumer's choice of court are governed by the terms of sale.

VSK reserves the right to modify these ToS at any time. Users will be notified of major changes via a notification on the ganyu.fr website or the official Ganyu Discord server.

12. Server administrators

This section applies to anyone who adds Ganyu to a Discord server or configures it, from the dashboard or through commands (the "administrator").

  • Controller: the administrator is the controller, within the meaning of the GDPR, of the members' data processed by the features they enable and configure on their server (logs, moderation, tickets, giveaways, welcome messages, and so on). VSK processes that data on their behalf, as a processor.
  • Informing members: the administrator informs the members of their server about the processing they set up, for example in the server rules or an information channel, and tells them how to exercise their rights.
  • Lawful basis: the administrator makes sure they have a lawful basis for their moderation and for the features they enable, and uses them proportionately. VSK controls neither moderation decisions nor the reasons behind them.
  • Member requests: the administrator answers requests from their members about their server's data. VSK assists them under the terms of the data processing agreement. The administrator accepts that the data export and account deletion each member makes themselves on Ganyu also apply to their server's data, sanctions and warnings included.
  • Data processing agreement: adding the bot to a server or configuring it means accepting the data processing agreement (DPA), which forms part of these Terms.
